The Professional Consultants Certificate is an essential asset for anyone looking to sell (or purchase) new build homes, but the outcome of a recent legal case highlights also just how important the certification is in relation to a surveyor’s role in the property process.
Hart Vs Large Legal Case
The recent publishing of the legal case of Hart V Large has provided essential guidance on the scope of a surveyor’s role when advising prospective purchasers, with one of the key outcomes of the case being the surveyor’s (Mr Large) failure to recommend that a Professional Consultant’s Certificate should be sought in his report.
In regards to this key element of the case, it was concluded that the property was in such a state of damp that an architect would have refused to provide a Professional Consultants Certificate, meaning that the claimant would not have gone ahead with the purchase.
The court ruled that, as a newly-constructed property, the building did not have the benefit of a NHBC warranty and therefore needed the assurance of a professional body such as the PCC.
The Importance Of The PCC For Surveyors
Our focus when providing a PC Certificate is usually on the party looking to seek a mortgage (whether this is a buyer or an owner looking to secure a buy-to-let mortgage) , but there is also an importance of wider understanding within the industry. Surveyors should be confident in understanding when to recommend the Professional Consultant’s Certificate to their clients. Our product is important to protect both the purchaser and to prevent cases of negligence by the surveyor.
What Does A PC Cert Do?
The PC Certificate is a UK Finance-created certification on behalf of banks to formalised standardise the certification of newly built or newly converted residential property. Administered by a professional consultant (such as an architect registered with ARB), the Professional Consultants Certificate is accepted by all major mortgage providers. Provided as both a monitored service (pre build) and retrospective service (post build) the PC Certificate is used to ensure that the property was built or converted under a building standards indemnity scheme that is acceptable to mortgage lenders.
