    Hart Vs Large Legal Case

    The recent publishing of the legal case of Hart V Large has provided essential guidance on the scope of a surveyor’s role when advising prospective purchasers, with one of the key outcomes of the case being the surveyor’s (Mr Large) failure to recommend that a Professional Consultant’s Certificate should be sought in his report.

    In regards to this key element of the case, it was concluded that the property was in such a state of damp that an architect would have refused to provide a Professional Consultants Certificate, meaning that the claimant would not have gone ahead with the purchase. 

    The court ruled that, as a newly-constructed property, the building did not have the benefit of a NHBC warranty and therefore needed the assurance of a professional body such as the PCC.
